James McNicol Smith practises in all areas of commercial law.

James has a broad commercial practice, with particular focus on construction, energy and insolvency matters. He has significant experience in domestic and international arbitration.

Before coming to the Bar, James was a Senior Associate at Clayton Utz in the Major Projects & Construction group.

James holds a Bachelor of Laws (Honours) and a Bachelor of Engineering (Honours) from Monash University. He is presently undertaking the Master of Laws at the University of Melbourne.

James was recognised in the 2023, 2024 and 2025 editions of Best Lawyers: Ones to Watch in the Construction Law category.

James is reading with Damien McAloon. His senior mentor is Nicholas Hopkins KC.
